Ustimenko V. Property of Territorial Gromada of Towns and Cities (Economic and Legal Aspects)

Object of research: the public relations arising owing to attraction of the property territorial gromada of city in an economic revolution. The purpose of research: a substantiation of the new theoretical-methodological approaches to the property right territorial gromada of city, its economic-legal nature, theoretical rules and offers on perfection of the economic legislation. Methods of research: dialectic, historical, rather-legal, system-structural, analytic-synthetic, logic-legal. Theoretical and practical results: the important scientific problem of development of economic-legal bases of the relations of the property territorial gromada of city is solved, which decision promotes more effective formation and use of objects of the property right territorial gromada in a urban economic complex. The results of research are used in practical activity of the executive committee of Donetsk municipal council, in educational process at teaching disciplines "the Municipal right" and "the Constitutional right of Ukraine", in the right creativity of activity Supreme the Ukraines Are glad. Scientific novelty: for the first time in Ukraine the complex research of economic-legal aspects of the property territorial gromada of city is carried out. The essence of concept "the municipal property of a territorial community of city" is determined. The features of formation of objects of the municipal property of city are investigated and their classification is carried out. The necessity of introduction in a legal revolution of concepts "the exclusive property territorial gromada of city", "municipal treasury" is proved. The offers on perfection about transfer of objects of the municipal property to a state ownership, privatization of the municipal enterprises, rent and concession of objects of the municipal property of city are developed. The problem questions connected to delimitation of economic powers between bodies of local self-management of city, and also between them and state bodies are solved. Is established, that the charters territorial gromada of cities reconstruct the basic legislative rules in sphere of management of the municipal property and adapt them for local conditions of managing. Sphere of use are the subjects of the legislative initiative; bodies of local self-management for use during realization of the competence, given by it; the subjects of managing; higher educational institutions.
