Essay

Complex and systematic research of legal, theoretical and practical issues of defense (counsel) function in Ukraine's criminal procedure is realized. The research covers the period from 1864 till nowadays. Author reveals the notion of the defense function as category of criminal procedural law and process, structure and contents of its components; its universal character is substantiated. A new conceptual approach to subject-matter of defense in a criminal case is defined, as well as defense advocacy concerning its ascertainment or rebutment is analysed.
