Trofymenko V. Theoretical and juridical fundamental principles of differentiation of the criminal proceeding of Ukraine.

First in Ukraine we have studied theoretical and juridical fundamental principles of differentiation of the criminal proceeding of Ukraine in formal and structural aspect. We have researched the genesis of theoretical models as to the criminal form of action and characterized the system of its determinants. We have formulated the concept of differentiation of the criminal form of action; found out its goal, meaning and functions. We have explained the existence of two types of differentiation - functional and structural, which are strongly connected and influence directly the system of criminal proceeding. We have proved that the system of criminal proceeding as the operation of courts, parties and other participants of criminal proceeding is multilevel and consists of definite elements which build its horizontal and pedimental structure. Due to our research of theoretical and fundamental legal principles of differentiation of criminal proceeding we have formulated the suggestions for introduction of amendments and addenda to the criminal procedural law which is directed to its improvement.
