Essay

In the dissertation the general theoretical analysis of nature with the visa of education was carried out. The conceptual foundations of the methodology of knowledge of the visa of education are defined. The content and features of higher education as a legal phenomenon are investigated. The author's interpretation of the content of the concept «higher education» is proposed and the main features of this phenomenon are discussed. Characterized by factors and law-making, which determine the basis for the formation of higher education. The edges of education could be revealed and their content analyzed. Higher education models (Western European, Central European, East European and American) are distinguished. The dynamics of the development of higher education in a globalized society is traced. Characterized by the philosophy and the modern paradigm of higher education. The praxiological significance of higher education for the construction of civil society and the rule of law is highlighted and analyzed. It is proved that the legal nature of higher education is revealed through its mission as a specific and important component of culture, science, advanced ideas and progress, which performs important social functions from the translation of cultural ideas and values to the production of economically useful knowledge, which finds its consolidation in legislative and subordinate acts of the state, as well as international acts that form part of national law.
