The dissertation is devoted to the research of the theory and principles of international humanitarian law in the historical development and at the comtemporary stage. International humanitarian law concept and legal nature in the context of the world international relations development are revealed in the dissertation, its sources, subjects, functions and scope are considered. Examining the content of international humanitarian law, it has been shown that this branch of public international law includes not only the rules governing jus in bello or the law of armed conflict, but also the rules governing human rights, in particular in armed conflicts or related to. such conflicts. It is substantiated that based on the theory of international law, there are all the necessary grounds for the application of international humanitarian law to all subjects of international law – states, international organizations, national liberation movements and certain quasi-state entities, individuals, and under certain conditions – to parties to armed conflict of non-international character.
