Essay

The dissertation is one of the first in domestic legal science qualifying scientific work, which comprehensively explores the problem of theoretical and legal foundations of the investigative judge in criminal proceedings and developed a concept for the implementation of its competence. The structure and content of the elements of the competence of the investigating judge are considered, namely - the normatively established goals of his activity, the subject of jurisdiction, authority, responsibility for non-compliance with decisions; identified and characterized international standards that define the requirements for the organization and implementation of the judicial control function during pre-trial proceedings; investigated the implementation of the competence of the investigating judge in the application of measures to ensure criminal proceedings, in procedures aimed at collecting, ensuring the admissibility and preservation of evidence, as well as in reviewing complaints against decisions, actions or omissions of bodies of pre-trial investigation or prosecutor. As a result of the conducted research, the scientifically substantiated offers directed on improvement of normative maintenance of realization by the investigating judge of criminal procedural function are formulated.
