Andrushko O. Theory and practice of legal responsibility for offenses in criminal proceedings.

The thesis presents a complex research of the institute of legal responsibility for offenses in criminal proceedings. The scientific problem related to overcoming the fragmentary scientific explanation of theoretical and practical problems of legal responsibility for offenses in criminal proceedings has been solved. It is established that the legal responsibility for the offense in criminal proceedings by its legal nature is a criminal procedural institution, and by sectoral affiliation – a complex (intersectoral) one. The general provisions of the theory of legal responsibility for offenses in criminal proceedings have been developed and analyzed. Systemic problems of the sector types of legal responsibility for offenses in criminal proceedings have been revealed and ways of their solving have been offered. The author proposes a theoretical and legislative model of legal responsibility for offenses in criminal proceedings. Scientifically substantiated proposals for improving the norms of criminal procedure legislation and the practice of its application have been developed.
