Kryzhanovsky M. Measures of Criminal Law Regarding Legal Entities: Essence and Forms

The dissertation is about the complex research into the nature and forms of criminal in relation to legal entities which resulted in the development of scientifically substantiated proposals and recommendations for improving the legislation of Ukraine in the part of the normative regulation of certain provisions of the section XIV-I of the General part of the Criminal Code of Ukraine, the order of the using and fulfilling criminal- and-law measures in relation to legal entities. In the first section, devoted to the general theoretical principles of investigation of measures of criminal nature of legal entities, their legal nature and place in the system of measures of criminal law, it is established that the modern study of problems of state response to the offense by legal entities can be divided into two periods: a) the study conducted before 01.09.2014; b) the study conducted after 01.09.2014. During the first period, domestic and foreign scientists, as a rule, substantiated the necessity and feasibility of a potential possibility of criminal proceedings against legal entities.
