Kostenko S. Organizational and legal status of the Qualifications and Disciplinary Commission of Public Prosecutors

The dissertation research is devoted to the study of the general theoretical workings, as well as the acquisition of new theoretical knowledge related to the clarification of the legal status of the new state institute – the Qualifications and Disciplinary Commission of Public Prosecutors. In addition, the purpose of the study is to develop, on the basis of the aforementioned experience and knowledge, specific scientific and practical recommendations, the purpose of which is to resolve a large number of the deficiencies in the Commission's legal status and activities. It is concluded that the inconsistency and incompleteness of the legislation governing the legal status of this body hinder the reform of the prosecutor's office, do not ensure openness of the process of forming the prosecutor's corps and, accordingly, increase the efficiency of the activity of the prosecutor's bodies. The dissertation, including on the basis of thorough empirical research conducted in the work of the Commission from April 2017 to August 2019, has accumulated key issues that need to be addressed in order for the Commission to be able to effectively address its objectives.
