Kovalchuk A. Participation of a defense attorney in the process of reconciliation between a suspect and a victim during the pre-trial investigation

The dissertation is devoted to the systematic research of the problems of the defense attorney’s participation in the process of reconciliation of the suspect and the victim in the pre-trial investigation. The author found that today the institute of reconciliation in criminal proceedings has gained increased relevance in recent years as a result of several factors. Primarily, this trend is associated with both the influence of the international legal community and the positive practice of domestic implementation. This is due to the fact that the mechanism for reaching a compromise is characterized by the following positive characteristics: rapid compensation, humanization of criminal proceedings, procedural economy and more. The existence and the rise of the reconciliation institute with more than a thousand years of history shows that the positive effects of achieving friendly relations, reparation and release from the punishment have far more advantages than provoking confrontation and applying repressive methods.
