Yashchenko T. State Regulation of Financial Services Markets: Legal and Administrative Aspect.

The distinction between state regulation and other related categories, in particular with public administration, has been made. The relations which arise in the markets of financial services are analised, their classification on groups depending on features of the legal status of participants of such relations is carried out. It is established that the state and state-authorized entities can be participants in such relations as consumers of relevant services and as regulators of the behavior of participants in the relevant markets. The analyses of what subjects are endowed with the powers of state regulation in the field of financial services markets, their powers and features of the administrative and legal status is provided. The legal grounds for guarantees of independence of the regulatory state bodies are studied. The advantages of use of state regulation in certain areas of the economy and granting specific powers to special entities are clarified, given the special approach to the formation of employees of the authorized entity on the basis of expertise and professionalism, as well as special powers that guarantee the independence of regulators.
