The paper formulates an understanding of the role and place of the Ministry of Defense of Ukraine in the system of central executive bodies and substantiates that the legal status of the studied central executive body is regulated by law a set of general and special powers and guarantees, the implementation of which ensures its implementation tasks and determines its position in the system of public authorities.
Approaches to the classification of military standards in accordance with the directions of their impact on certain administrative and legal relations with the participation of defense forces have been further developed. The characteristics of the functions of the Ministry of Defense of Ukraine, which are proposed to be considered as a combination of their three main types: 1) general (organization, planning, regulation, decision-making, communication and control); 2) special (intelligence and mobilization); 3) support (personnel management, development (education) integrity, legal, financial, logistical, informational and social security).
The dissertation also clarifies that currently, in Ukraine the national legislation is being adapted to the conditions of Euro-Atlantic integration, an extremely important component of which is the military sphere, the sphere of defense and military construction. It is summarized that the adaptation in these areas of public policy covers three main areas: 1) bringing national legislation in line with the provisions of the Constitution of Ukraine, which are related to the implementation of Ukraine's strategic course to become a full member of the North Atlantic Alliance; 2) concretization of certain elements of the legal status of the Ministry of Defense of Ukraine and the Armed Forces of Ukraine, elimination of declarative, as well as ambiguous and inconsistent provisions; 3) creating conditions for improving the legal and information culture of the constituent forces of the Defense Forces and the Ministry of Defense of Ukraine.
A number of proposals have been developed for the adaptation of national legislation in the military, defense and military construction to the conditions of Euro-Atlantic integration, which include justification: 1) creation in the structure of the Ministry of Defense of Ukraine based on the positive experience for military police and STANAG 2226 NATO military police guidance and procedures of a special purpose law enforcement body - the Military Police; 2) taking into account the functions performed and the positive experience of the United States of America and the Republic of Latvia, reassignment of the National Guard of Ukraine to the Commander-in-Chief of the Armed Forces of Ukraine; 3) providing the Ministry of Defense of Ukraine with the opportunity to provide counter-intelligence protection of the state in the military, defense and military construction, which is consistent with the principles of military counterintelligence in NATO member states and NATO common doctrine STANAG 2192 "Allied joint doctrine for counter-intelligence and security procedures»; 4) amendments to the laws of Ukraine «On National Security of Ukraine», «On Defense of Ukraine», «On the Armed Forces of Ukraine», «On Standardization», as well as the Regulations on the Ministry of Defense of Ukraine, which are aimed at improving administrative and legal principles of Euro-Atlantic integration.
