Tarasiuk S. Criminal procedural mechanism for ensuring a person's constitutional rights when conducting investigative (search) actions in his / her ownership or other possession

In the dissertation on the basis of the analysis of criminal procedural legislation of Ukraine and practice of its application, scientific works of domestic and foreign scientists, generalization of empirical data, the complex investigation of the criminal procedural mechanism of ensuring the constitutional rights of a person in the conduct of investigative (search) actions was carried out in his home. It is proved that the constitutional rights of a person in criminal proceedings should be understood as a set of rights and freedoms enshrined and regulated by the criminal procedure legislation of Ukraine, which are given to participants in criminal proceedings to protect their legitimate interests subject to restrictions established by law. The basic normative-legal documents, which enshrine and guarantee the observance of the constitutional rights of a person in conducting investigative (search) actions in the dwelling, the concept of the constitutional rights of a person in criminal proceedings are analyzed.
