Ryabchenko K. The subject of evidence in criminal proceedings against a minor

The dissertation is a comprehensive study of the definition and regulation of circumstances to be established in criminal proceedings against minors. On the basis of the carried-out research the imperfection of a condition of doctrinal processing of the analyzed question is established. Methodological bases of research of a subject of proof in criminal proceedings concerning the minor are defined. The historical preconditions and sources of circumstances to be established in criminal proceedings against minors in the criminal process of Ukraine are considered. International standards for criminal proceedings against a minor are summarized. It is proved that the generality of the subject of evidence is expressed through a certain order of pre-trial investigation and the peculiarities of the circumstances to be proved in all proceedings where the suspect (accused) is a minor. The generality is not complete, as the relevant provisions apply only to a certain type of criminal proceedings and not to an individual case of a criminal offense.
