Essay

The thesis is one of the first special comprehensive studies of the essence and procedure of exercising the right to a fair trial in the criminal proceedings in Ukraine conducted in the national science of criminal procedural law. It has been established that the right to a fair trial was conceptualized through the adoption of the Convention for the Protection of Human Rights and Fundamental Freedoms, and the unification of its understanding and recognition at the level of standards of legal proceedings developed with the case law of the European Court of Human Rights (hereinafter – the ECHR). At the present stage of Ukraine's legislation development, a vector towards its alignment with the Convention standards of legal proceedings is clearly seen. The Criminal Procedure Code (hereinafter – the CPC) of Ukraine enshrines elements of the right to a fair trial in various principles of criminal proceedings.
