Yarusevych Y. Administrative and legal regulation of state export control over military and dual-use goods

The dissertation deals with the research of administrative and legal regulation of state export control over military and dual-use goods in Ukraine. The author argues that state export control is an integral part of the process of public administration, which consists in establishing the restrictions provided by law and verifying their compliance. The necessity of a dualistic interpretation of the concept of “state export control” in a broad and narrow sense is justified. In a narrow sense, it is the restrictions imposed by the state on foreign economic activity. In a broad sense, the concept of “state export control” should be defined as a set of measures in the system of regulation of foreign economic activity in relation to military and dual-use goods, carried out exclusively by public authorities, to ensure protection of Ukraine's national interests, compliance with international obligations. commitments on non-proliferation of weapons of mass destruction, their means of delivery, restrictions on the transfer of conventional weapons, as well as the implementation of measures to prevent the use of these goods for terrorist and other illegal purposes.
