Yurikov O. Criminal responsibility for intentional damage or destruction of the telecommunications network

The dissertation is a complex scientific monographic study of criminal liability for intentional damage or destruction of the telecommunications network. On the basis of the conducted research the imperfection of the state of doctrinal elaboration of the analyzed question is proved. Methodological bases of research of criminal liability for intentional damage or destruction of a telecommunication network are defined. Based on the study of historical sources, the periods of development of criminal law protection of telecommunications facilities in Ukraine are defined to following statements: 1) formation of preconditions and establishment of criminal liability for encroachment on telecommunication objects (1855–1903); 2) consolidation of articles on criminal liability for encroachment on telecommunications facilities, humanization of punishment for such acts (1903-1922); 3) regulatory development of criminal liability for encroachment on telecommunications facilities in view of the development of science and technology (1922-2001); 4) development of telecommunication objects security by criminal legal system (from 2001 to the present). It is stated that criminalization of encroachments on telecommunications facilities has been and remains a positive effect on protection of property by criminal legal system, public safety and the state defence.
