Liulchuk N. Legal Aid Provision Agreement in Civil Law of Ukraine

The thesis is devoted to the research of features and legal nature of the agreement on rendering legal aid in the civil law of Ukraine. The author studies the theoretical, legal and methodological principles of the agreement on the provision of legal assistance in the civil law of Ukraine. In the relevant context, it is established that the historical stages of formation of the institution of legal aid correspond to the stages of non-contractual and contractual regulation of legal aid, such as: the Old Rus period of Ukrainian history; the period when the territory of Ukraine was under the rule of other states; Soviet period of Ukrainian history; the period of formation and development of independent Ukrainian statehood; period of democratic reform in the Ukrainian state. It is determined that legal aid means the provision of legal services aimed at ensuring the realization of human and civil rights and freedoms, protection of these rights and freedoms, their restoration in case of violation. At the same time, legal services mean: providing legal information, advice and clarification on legal issues; preparation of applications, complaints, procedural and other legal documents; representation of interests of the person in court, other state bodies, local governments, before other persons; ensuring the protection of a person from prosecution; providing assistance to a person in ensuring a person's access to secondary legal aid and mediation, etc.
