SVYRYDENKO N. Legal and social protection of the personnel of the State Criminal and Executive Service of Ukraine

The dissertation provides a theoretical generalization and proposes a new solution to the specific scientific issue by formulating doctrinal principles regarding legal and social protection of personnel of the State Criminal and Executive Service (hereinafter – SCES) of Ukraine and the substantiation of prospect directions for its improvement. On the basis of modern ideas about the juridical nature of legal and social protection of personnel of the SCES of Ukraine using a systematic approach, the dissertation formed a number of new theoretical positions and formulated a number of practice-oriented proposals that certify the author’s contribution to the development of the given issue, in particular, the definition “legal protection of personnel of the SCES of Ukraine” is formulated; the concept of “social protection of the personnel of SCES of Ukraine” is defined. The dissertation developed a Draft Law of Ukraine “On Amendments to Certain Laws of Ukraine Concerning Strengthening Guarantees of Legal and Social Protection of the Personnel of the State Criminal and Executive Service of Ukraine”. Within the framework of the proposed draft Concept of Personnel Policy in the SCES of Ukraine, as well as the results of the analysis of conceptual regulations on reforming the penitentiary system, the priority areas of legal and social protection of SCES personnel are substantiated. The practical significance of the obtained results is that the formulated provisions, conclusions and proposals in the dissertation are a specific contribution to both legal science and the practice for ensuring the formation and implementation of state policy by the Ministry of Justice of Ukraine according to the execution of criminal punishments and probation, legal and social protection of personnel of the SCES of Ukraine.
