The dissertation is devoted to the study of theoretical and legal problems of regulating the information security sphere in Ukraine, taking into account the peculiarities of law enforcement measures in this area, taking into account additional external threats associated with the full-scale Russian invasion on February 24, 2022, the author analyzes the state of legal support of the information sphere in certain European countries and the United Kingdom, identifies sources of threats in the areas of access, possession, and disposal of database arrays and other information classified as different levels of legal and technological protection.
The author's theoretical and legal analysis of the current regulatory framework in the field of information protection within the framework of this study demonstrates a close combination of internal mechanisms for stabilizing the established procedure for working with information of different levels of protection and a general approach to ensuring national security. This circumstance is one of the main ones in determining the role and importance of ensuring an adequate level of protection of the information security sphere as a kind of circulatory system, thanks to which all components of national security interact and coordinate their actions.
The current state of social relations, primarily between citizens and the state, is shaped by the rapid development of digital technologies, when virtually all areas of life are transformed into electronic communication. Without most digitalized services, it is almost impossible to imagine situations that require a quick and accurate solution. At these levels, the task of proper protection of the information sphere becomes particularly relevant, since mechanisms for remote access to databases, primarily personal and financial, are under a permanent threat of being hacked, and such unlawful actions can cause significant material and moral damage.
The study of the theoretical, scientific and regulatory framework of the information sphere protection has shown that there is a significant gap between these components, which negatively affects the overall functioning of the information component in the overall national security mechanism. In this regard, it became necessary to carry out an in-depth analysis of the source base, to develop scientific and practical approaches to understanding both the concept of "information security" and other derivative concepts (e.g., threats to information security, sources of threats to information security, etc.).
From the material analyzed, a number of conclusions have been drawn which are based on the results of applying methodological tools of scientific research and which testify to the constant dialectical relationship between the material and spiritual parts of the general concept of "information security". In this regard, we rely on an extensive scientific heritage and a rich regulatory framework, which make it possible to express the author's vision of the issues of ensuring the proper state of information security, as well as to demonstrate a critical attitude to the published information on this issue.
The reference to historiographic sources contributed to the disclosure of new aspects among the presented scientific approaches to understanding the concept of "information security". In turn, the correct interpretation of the semantic meaning of the system-forming categories in the formation of a specific concept (e.g., the source of threats to information security) is the key to drawing a logical and correct conclusion, which is evidence of the maturity of a scholar and his/her ability to make theoretical and legal generalizations in a particular area of legal science.
A special place is given to the selection of methodological tools for the study. This selection was made on the basis of the exclusive importance of the sphere of information support in interaction with other areas of state building and national security. At the same time, we note that the raised issues are interdisciplinary in nature due to their legal and structural nature: legal, economic (technological) and moral and psychological components. Under such circumstances, the philosophical-dialectical method is of utmost importance given its epistemological nature, which will facilitate the author's conclusions and judgments that will be characterized by consistency and progressiveness.
The use of general scientific research methods will ensure the realization of the tasks of the most complete and comprehensive generalization of scientific achievements and the regulatory framework in the field of information security, the derivation of new permanent links between individual elements of the integral concept of "information security", as well as proposals to improve the effectiveness of preventive and preventive measures in the areas of protection of the information environment of Ukraine.
