Sakhnii A. Administrative and Legal Framework for Military Service by Women in Ukraine

The dissertation presents a comprehensive disclosure of the issues of administrative and legal provision of military service by women in Ukraine through the prism of the implementation of administrative and legal regulation and administrative and legal influence on the part of the state on an ordered and structurally agreed model of military service relations, which takes into account the importance of regulating and protecting the rights of women in the military sphere, in particular at the level of legislation and administrative procedures. The content and essence of the legal concept "military service" is characterized through the prism of a special type of public service in Ukraine. The democratic principles of military service have been defined and the principle of gender equality should be given a place among them. The legal nature of the regulatory and legal provision of women's military service in Ukraine is disclosed, as well as the system of regulatory and legal acts that objectify its essence is identified. The concept was formed and the elements of the mechanism of implementation of the administrative and legal provision of women's military service in Ukraine were characterized. A system of guarantees for women's military service in Ukraine has been defined. The procedure for women's military service in Ukraine has been revealed. The degree of actualization of the need to optimize the administrative and legal mechanism for ensuring women's military service in the conditions of the armed conflict in Ukraine is clarified. A comparative characterization of the experience of ensuring women's military service was carried out on the example of NATO countries. The trends of improving the administrative and legal provision of women's military service in Ukraine have been determined.
