Martenko A. Psychological analysis of certain legal criminal terms (according to the current Criminal Code of Ukraine).

Об'єкт дослідження - juridical - psychological aspects of legal criminal regulation. Мета дослідження - researching the theoretical basis and practical scientifically proved offers which are directed on improvement of the current Criminal Law and practice of it's administration in modern conditions. Методи дослідження - system; structural-functional; analysys; synthesis; analogy; deduction; induction; legal comparative; legal-logical; mathematical-statistical; researching of materials of criminal cases; using questionnaires. Наукова новизна одержаних результатів - the versions and levels of interaction of jurisprudence and juridical psychology are determined. The necessity of carring out the analysis of all components of the structure of mental (intellectual, volitional and emotional) while determining the form and type of the guilt behaviour are proved. The criteria for differentiation of direct and eventual intention under the psychological contents of a course of intellectual and volitional its moments are determined. It is proved that requirements and motive are indifferent to the criminal behaviour. Практичне значення одержаних результатів - the complex of the offers which are directed on improvement of the current Criminal Code of Ukraine was researched and proved. Предмет і ступінь впровадження - theoretical results of dissertation and the offers on improvement of Criminal Law legislation and administration; use in: activity of State customs service of Ukraine, activity of General Department on struggle with the organized criminality of Ministry of Internal Affairs of Ukraine, educational process of National Academy of Internal Affairs of Ukraine.
