Kovalyova Y. Organizational and Legal Foundation for Prosecutor’s Refusal to uphold Public Prosecution in Court

The thesis is devoted to the research of theoretical and practical problems as to supporting state charge in court as well as refusal to support public prosecution. The work examines issues connected with the refusal of prosecutor to uphold public prosecution: defines and establishes reasons and factors which give ground for prosecutor’s viewpoint; analyses the consequences of the refusal for the main subjects of a criminal process. The author also offers to introduce changes into the active legislation of Ukraine and departmental acts Prosecutor General Office of Ukraine which regulate the actions court and prosecutor’s office in case of public prosecutor’s refusal to support official prosecution; their adoption is to eliminate defects in the regulation and organization of public prosecution and to improve effectiveness of public prosecutor’s refusal to support state charge in court.
