Essay

The subject of research is the social relations that arise when using commutation of juvenile offenders. The purpose of the research is development of psycho-legal principles applying circumstances that mitigate punishment on persons who committed the crime in juvenile age. Methods of research are general scientific, ones of juridical-psychological researches and of mathematical statistics. Scientific novelty - generalized scientific approaches to mitigate the sentence juvenile offenders; formulated juridical and psychological principles applying commutation order, set objective and subjective difficulties that hinder the application of science-based mitigation of the punishment to minors; the authorized version definition index Rigidity punishment "in light of adolescence, its interpretation and calculation procedure and others. Practical importance: the justification algorithm organizational and legal measures related to implementation in legal practice palliative for juvenile offenders. Subject and degree of implementation: results of the research are applied in: the practice of Ukraine's Supreme Court, Appellate Court of Chernivtsi region and in the educational process of the Kiev National University of Internal Affairs.Efficiency of implementation: acts of implementation bear out positive assessment of application of research results. Sphere of appliance is law enforcement and educational to regulate social relations arising from the application of mitigating punishment of juvenile offenders.
