The subject of research is social relations in the sphere of the life and health of citizens are violated as a result of criminal failure to provide assistance. The purpose of the research is to develop theoretical principles and practical recommendations for optimizing the criminal trial of investigation and judicial proceedings of criminal cases related to failure to provide assistance to a person who is in a life-threatening condition. Methods of research are general specific, juridical and psychological methods of research. Scientific novelty - a comparative analysis of criminal-law countries the laws concerning the functioning of the rule of the failure to provide assistance as a form of criminal inaction; reasonably high level of latency of crimes related to failure to provide assistance because of the difficulty setting features of the subjective side of a crime related to background estimation circumstances of a purely psychological nature, and others. Practical importance: is validation algorithm organizational and legal measures to enhance the functioning of penal provisions in respect of criminal failure to provide assistance, provided suggestions for improving forensic investigation of criminal inaction by using special psychological knowledge and others. Subject and degree of implementation: results of the research are applied in: the practice of courts and in the educational process. Efficiency of implementation: acts of implementation bear out positive assessment of application of research results. Sphere of appliance is law enforcement and educational process for improved consideration of crimes related to failure to provide assistance to a person who is in a life-threatening condition.
