Essay

Object - social and philosophical traditions just war and perpetual peace. The aim is to reveale a new content of traditional social and philosophical ideas of just war, transformed under the influence of the theory of perpetual peace, in particular Kant. The methods are hypothetico-deductive system, historical genetic, interdisciplinary synthesis. The thesis presents an inquiry into the problem of a transformation of traditional content of idea of just war influenced by Kantian theory of perpetual peace. We attempted to connect philosophical traditions of just war and perpetual peace, notwithstanding that these traditions developed separately from one another, because they issue from general suppositions, based on theory of natural and civil law. It is proved that emphasis on moral explication of justice lead not only to attempt moral limitation of war, but to it moral justification, and classical understanding war as continuation of politics by other means - to legitimization of war and establishing only armistice. We demonstrate a new content of idea of just war as a result of actualization by legal interpretation of justice, based on principals of equality and objectiveness, and anti-instrumentalist approach to understanding war as powerlessness politics. Evolution of idea of just war in the direction of legal war under jus gentium related to manifestation the priority human right over interests of national state. General tendency of further evolution this idea lies in the fact that it will be absolute scientifically inadequate. Application sphere is the training courses.
