Prokopenko B. Candidates Selection for a Judge Position.

Theoretical and practical issues of candidates selection for a judge position are investigated in the research. There was also studied the essence of candidates selecting procedure for judicial office and the procedure was split into main phases and stages. The author analyzed the requirements for judicial appointment, stressed the need to differentiate requirements for a candidate who is going to take a judge position and for a judge in connection with the investigation of a person's legal status, who claims to take a judge position. Each stage of candidate selection for a judge position was considered in details which is performed by the Supreme Qualification Commission of Judges in Ukraine. They are: anonymous testing, a special test, special training, qualifying examination, the competition for vacant judicial position. There were investigated the procedure of judicial candidates appointment and judge's oath as the final phase of judicial powers obtaining. The author analyzed normative legal acts which regulate candidates selection for a judge position at both the national and international levels. There were found out some legal gaps in regulation of carrying out the procedure of candidates selecting for a judge position. The propositions about improvement of legislation which regulates judicial system in Ukraine were stated on the basis of performed scientific researches.
