Honchar V. Organizational and legal aspects of the constitutional publicity principle of the trial.

The thesis is devoted to the study of complex organizational and legal aspects of the constitutional principles of publicity judicial process to identify gaps practical mechanism for implementing the said principles, as well as the formation of science-based proposals to improve legislation on the judiciary, judicial legislation and law enforcement practices. On the basis of the Constitution and laws of Ukraine, international legal acts in the field of justice and legal advances of science, the author analyzes the historical and legal features of the evolution of the idea of publicity trial disclosed the nature and content of the constitutional principles of publicity litigation, to its place in the other principles of justice, investigated the mechanism of its implementation, the proposed system measures the effective organizational and legal support open hearings and public awareness about the progress and results of the trial. In this dissertation formulated proposals to improve legislation of Ukraine concerning legal regulation mechanism of the constitutional principles of transparency litigation, including securing legitimacy criteria limiting publicity trial, the order of entries in the courtroom, improve the legal protection of confidential information, which is investigated in the closed court.
