Potylchak O. Comparative analysis of the legal status of judges and organization of courts of general jurisdiction of Ukraine and some countries of Europe

In this work the legal regulation of a number of national models for acquiring the status of a professional judge, his dismissal, disciplinary proceedings. Based on a comparative analysis of the laws of individual states of Europe and Ukraine classification models of self-government for the criterion of the presence in the national legal systems of the Representative body which is independent from the legislative and executive branches of government, at least half of whose members are judges elected in the prescribed manner to other judges the principles that guarantee maximum of the judiciary. Highlights the discrepancy national regulatory regulation of disciplinary action in the form of reprimand only (Art. 88 of the Law of Ukraine on the Judicial System) basic European standards ensuring compliance status of judges in a democracy.
