Essay

The thesis is devoted to Zhytomyr district court as one of the elements of the post-reform justice in Right-Bank Ukraine. It is found out that judicial reform represented a complex and multifaceted process. The absence of main idea led to a slowdown in the preparation of the reform. Right-Bank chose its way in the issue of judicial reform including courts. The factor of presence of large amount of Poles did not give opportunities for rapid attachment of general judicial system including the judiciary. Therefore, the government started working towards a gradual adaptation of the land. It is determined that the specificity of the introduction of judicial reforms in 1864 in Right-Bank Ukraine was explained primarily by the existence of the Polish factor. It is noticed that the structure of Zhytomyr District Court fully corresponded to the legal regulations of 1864. Promoting its own influence in the district courts, the government started to practice such kind of appointment as "person who fulfils the duties", which accordingly delivered the court investigator from the declared principle of "immutability of the appointment" and that's why such status made an obedient executor of any will of the leadership from any official.
