Essay

This thesis is a scientific investigation of the notion of court independence as the basis for organization of the judicial power, international and legal standards of court independence as the basis for the judicial power organization, as well as the newest legislative regulation of the basis for organization of the judicial power in Ukraine and complex determination of the tendency of the development of court independence as the basis for the organization of the judicial power in democratic legal state. In this work historical stages of formation and development of the institution of court independence in Ukraine, scientific opinions and approaches of doctrinal comprehension and the definition of court independence are highlighted, basic features of the notion of court independence as the basis for organization of the judicial power, international and legal standards of court independence as the basis for the judicial power organization are provided. Results of the investigation of the genesis of court independence institution on the territory of Ukraine testify that such elements of society organization as legal system, which foresees the rule of individual's right, political system, which secures functioning of the independent judicial power as a component of state power, civil society, legally established forms of people's participation at performing judicial proceedings and organization of the judicial power, social justice as the basis for society's development promote the establishment of court independence.
