Essay

The dissertation is an independent, complete scientific work, which examines the theoretical, organizational and legal foundations of access to advocacy in Ukraine. On the basis of the analysis of scientific sources and normative legal acts, the author defines the content of the concept of «access to advocacy» and describes its features. The genesis of the formation and development of normative regulation of access to advocacy in Ukraine and in the world is outlined. The guarantees of access to advocacy are defined and classified. Legal characteristics of legal and organizational-legal guarantees of access to advocacy are provided. In the research the theoretical principles of the legal mechanism of access to advocacy activity have been developed and the peculiarities of legal regulation of access to advocacy activity have been established. The essence of international standards of access to advocacy activity is revealed. The dissertation examines the stages of the process of acquiring status of lawyer and the parties of the procedure for acquiring status of lawyer. In the framework of this research, the author has developed and provided suggestions for improving the current legislation of Ukraine on access to advocacy activity.
