Ponomarova O. Legal status of the Commercial Cassation Court in the Supreme Court in Ukraine

The Theses examines the theoretical, legal and praxeological principles of the legal status of the Commercial Cassation Court in the Supreme Court in Ukraine. Based on the comparative analysis of sources of law in various historical periods, as well as scientific literature, the beginning of the origin and peculiarities of the genesis of the cassation instance in economic legal proceedings were established, as well as the stages of its origin and formation. The organizational and legal forms of the cassation instance in economic legal proceedings of foreign countries are investigated. Based on the analysis of domestic and international scientific sources, the author identified such concepts as «the powers of the Commercial Cassation Court in the Supreme Court», «organizational and legal support of activities of the Commercial Cassation Court in the Supreme Court» and «administration in the Commercial Cassation Court in the Supreme Court». In the dissertation the classification of functions of the Commercial Cassation Court in the Supreme Court, as well as its powers was carried out. The peculiarities of the organizational and legal support of the Commercial Cassation Court in the Supreme Court and its administration were investigated, the subjects and content of the above-mentioned activity were determined. The essence of the criterion of «integrity» is clarified through the prism of its main features. The procedure of selection of judges of the Commercial Cassation Court in the Supreme Court, as well as employees of its secretariat, was investigated.
