Tulba K. Legal regulation of international travel of citizens in international agreements of Ukraine.

Thesis is devoted to studying international legal basis of functioning of legal regimes for undertaking international travel by citizens, to determining peculiarities of their legal regulation and grounding ways of its improvement. The paper describes the state of the scientific study of the international legal aspects of undertaking international mutual travel of citizens. Based on the analysis of the history of the development of legal provision of international relations in the field of undertaking international mutual travel of citizens its division into periods was carried out and the selected periods were characterized. The state of legal provision for cross-border movement of citizens across the border of Ukraine has been analyzed and summarized. Analysis of the provisions of international agreements on liberalization of visa regime with the participation of Ukraine allowed to highlight and disclose the content of their common and special features, as well as to improve their classification depending on: status of the parties to international agreements; their names; the aim and the subjects of distribution. The paper gives the specified definition of the notion «international agreements on mutual travel of citizens» and their comparative legal characteristics. A study of the provisions of the Agreement between Ukraine and the European Communities (European Union) on facilitation of the issuance of visas of of June 18, 2007, as amended on July 23, 2012, and the Regulation (EU) 2017/850 of the European Parliament and of the Council of May 17, 2017 on visa liberalization for citizens of Ukraine, was used as a basis for summarizing their significance for legal regulation of international travel of citizens of Ukraine. An analysis of the provisions of the agreements on local border traffic with the participation of Ukraine allowed to establish their essential conditions and to generalize them. The thesis identifies the shortcomings of the use of legal regimes for the international travel of citizens, which are summarized within its two components: the shortcomings of legal and organizational support. Based on the analysis of the state of legal support for cross-border movement of citizens, the views of scientists on the improvement of legal provision, the ways of its improvement within the formal, security and organizational regulatory framework are highlighted and substantiated.
