The dissertation based on the results of the research solved the tasks of substantiating the theorist of legal provisions of general and special theories of criminal procedure, determining the information content of the evidence and proving the circumstances of a criminal offence, the procedural status of the parties, participants in criminal proceedings. The scientific novelty of the results is that the dissertation is a comprehensive scientific study of the analysis of theoretical provisions of organizational, legal, procedural activ ties of the court in establishing the subject of informational evidence, determining the informational process of proving the circumstances of a criminal offence. The conclusions of the dissertation reveal the theoretical approaches of general, special and private methods of the cognition process. The paper formulates practical recommendations for further improvement of current legislation, bringing it to a single content between theory and practice.
