Essay

Dissertation is devoted to the problem of methodological ensuring of process in the sphere of judicature: the creation of qualitatively new system of knowledge - the theory of forensic cognition; the determination of its structure and the main categories; the characteristic of forensic cognition and making proposals aimed at the improvement of procedural regulation of cognitive legal relationships as well as recommendations on a better solution of practical tasks in this sphere. There have been made conclusions as to the need for unification of legislation regu-lating the judicial procedure, as well as the need for creation of a unified code of the judicial system or the code of public and the code private legal proceedings. Based on the activities of the chairs of criminalistics of the main legal higher educational estab-lishments there has been formulated the idea of creating the chairs of the theory of judi-cial cognition. There has also been substantiated the need for enumeration of legal spe-cialities, as well as renaming of speciality: 12.00.09 - Criminal Procedure and Criminal-istics; Forensic Expert Examination by speciality: Judicature; Theory of judicial cogni-tion. Certain contribution has been made to defining the approaches to classification of traces in criminalistics, the concept of mechanisms of formation of judicial evidence, as well as the system of methods of scientific cognition and tactical means based on them which are used in the sphere of judicature.
