Brytanska E. Prevention of crimes against property committed by minors

The dissertation is devoted to the research of theoretical and practical problems of functioning of the mechanism of prevention of crimes against property committed by minors, on the basis of scientific works of scientists of various branches of law and other related sciences, normative-legal basis of prevention of crimes against property committed by minors, judicial practice and official consolidated statistics on the number of committed criminal offenses in Ukraine. The paper provides a theoretical generalization and a new solution to the scientific problem, which is to clarify the nature and features of the mechanism for preventing crimes against property committed by minors, as well as to develop proposals and recommendations for improving relevant legislation. The system of prevention and counteraction to criminal offenses against property committed by minors is comprehensively studied, taking into account scientific approaches and practical materials that reflect the actual level of crime. Based on the analyzed scientific and educational literature, as well as statistical information from official sources, it is argued that crime is destructive (for a particular society) activities of individuals or their groups in a particular area, clearly defined by the legislator as punishable. The social and legal nature of crimes against property committed by minors is revealed, the structure of crime is investigated and its essence is outlined, criminal-legal features and classification of crimes against property committed by minors are given. The need to modernize the judiciary in the context of the implementation of the juvenile justice mechanism is pointed out, as given the number of cases heard by local courts, the issue of individual treatment of each juvenile in need of assistance does not arise at all.
