Studenets I. Concession model of public-private partnership

The dissertation is the first systematic and comprehensive study of the legal regulations of the concession model of public-private partnership in Ukraine, which allows to form a comprehensive understanding of the concepts and features of the concession, the history of the development of concessions, an overview of the legal regulation and functioning of concessions in Ukraine with an in-depth analysis of selected topical issues, as well as features of the concession as a mechanism for the Ukrainian economy’s recovery in the post-war period. The legislative introduction of the term "public-private partnership" instead of the concept of "public-private partnership" is argued, which will allow to fully cover the subjects, achieve compliance with the generally accepted terminology of the European Union and considering the position of anthropocentrism aimed at ensuring the interests of society through the state and local self-government. It is proposed to include publicprivate partnership and concession as its model in the spheres of public investment management and public procurement in accordance with the pan-European approach. Within the framework of the PhD study, the author summarized the approaches to understanding the concept of concession, namely: economic (commercial) and legal institute; business activity; system of relationships; contractual model of public-private partnership; special economic (commercial) regime; authoritative public document; transferable objects; contract (agreements); permission – with a recommendation to avoid using concepts of permission and authoritative public document as denying the partnership nature of the relationship.
