Essay

Comprehensive research of the land road transport structure of Ukraine has been carried out. Automobile roads have been analysed in accordance with their technical classification, capacity, purpose. The factors influencing the development of both the automobile network and its transport infrastructure have been formed. Suggestions for regulatory improvement and legal base of road transport land use and road economy have been given. The main tasks for ensuring financial and investment policy, in particular the public-private partnership development, long-term preferential lending to energy-saving technology and technology, technological modernization of road transport have been determined. It has been determined that there is no specialized regulatory framework for quality management of road construction or reconstruction. Regulatory documents require the inclusion of quantitative quality criteria, both in individual processes and in the overall assessment of the work quality in the road industry. Regulatory - legal documents need further improvement, creation of an interconnected system that will ensure quality in roads construction and their reconstruction. The coordination project mechanism of land management for the allocation of land plots for the location, construction and operation of road facilities have been proposed. Legislative framework for land use of road vehicles should be directed to the use of accurate and up-to-date information on the length of roads, their smooth functioning and control by the relevant services of road transport infrastructure, constant updating of the condition of the roadway for proper planning and organization of repair works, design of construction and repair works auto junction. The implementation of the proposed suggestions in the land legislation would provide an opportunity to facilitate the resolution of allocation problems and registration of the right to use the land plots for the location, construction and road facilities operation, which should be taken into account when preparing the wording of the relevant legislative acts. It is established that the regulation of land use and road economy is that the composition, status, procedure for granting, removal of land (redemption), transfer of roads to concessions, land taxation, environmental protection are addressed in various legislative acts. acts whose parts have not been codified. The improvement directions of the lands legal regime of the road economy, its direction on the effective use and protection of the lands, simplification of the procedure of acquiring the rights to land have been proposed. The proposal to amend Article 71 of the Land Code of Ukraine and to separate the road economy land into a separate article of the Code has been justified. It has been considered that it is necessary to carry out codification of determining the composition of the automobile roads and road economy, by introducing the specific amendments to the Land and Tax Codes, Laws of Ukraine "On Transport", "On Roads", to a number of by-laws. In particuar, it is advisable to regulate the land reservation issues, establishment of roadside, protection and sanitary protection zones along automobile roads and land use regimes as part of an additional (new) article of the Land Code.. The ecological and economic component of the roadside stripes use has been considered and the problems of illegal plowing has been identified. Legislative measures has been proposed for improvement the environmental situation of roadside areas. It has been found out that land reservation is a legal necessity for the regulation of land relations, meeting the needs of the population, branches of the economy in the land and its rational use and protection, in particular for the construction of roads and should be carried out in accordance with regulatory documents.
