Mukan I. The mechanism of execution of decisions of the European Court of Human Rights in Ukraine: state and administrative dimension.

The object of the research is public administration in the sphere of functioning of the justice system of Ukraine.The purpose of the dissertation work is to scientifically substantiate the mechanism of implementation of the decisions of the European Court of Human Rights in the state-management dimension.The work uses special and general scientific methods of scientific knowledge determined by the goal and tasks of the dissertation research, namely: systemic analysis - during the examination of the functioning of individual elements of the mechanism for implementing decisions of the European Court of Human Rights and their interrelationships; generalization - when studying the experience of European countries in organizing the implementation of decisions of the European Court of Human Rights; comparison - when determining the trend of the formation of the mechanism for the implementation of decisions of the European Court of Human Rights; statistical - during the analysis of the results of the implementation of the decisions of the European Court of Human Rights; modeling – during the substantiation of the structural and functional model of the domestic mechanism for the execution of decisions of the European Court of Human Rights; forecasting – when determining measures to reform the mechanism for implementing decisions of the European Court of Human Rights.In the dissertation, the theoretical, organizational, legal and functional justification of the mechanism of implementation of the decisions of the European Court of Human Rights in the state-management dimension is carried out. In particular, the essential features of the mechanism for the execution of the decisions of the European Court of Human Rights are revealed, theoretical approaches to its improvement are summarized, the normative and legal support of the mechanism for the execution of the decisions of the European Court of Human Rights is analyzed, and problematic components in its functioning are identified. The experience of European countries in the organization of the process of implementation of the decisions of the European Court of Human Rights is summarized and its structural and functional basis is substantiated in the conditions of Ukraine. The structural and functional model of the mechanism for the execution of decisions of the European Court of Human Rights was analyzed and its key conventional and national elements were identified. The role of the control function of the mechanism of execution of decisions of the European Court of Human Rights is justified and its characteristic features are analyzed. The organizational and legal measures to improve the mechanism of implementation of decisions of the European Court of Human Rights in Ukraine are disclosed, and ways and forms of improvement of the mechanism of implementation of decisions of the European Court of Human Rights in Ukraine are proposed.
