Adamska I. Protection of the rights of public servants in modern conditions of Ukraine

The dissertation solves an urgent scientific task, which consists in the theoretical and methodological substantiation of the system of protection of the rights of public servants in modern conditions of Ukraine and the development of promising directions for its improvement. The paper proposes a mechanism for improving the system of protection of the rights of public servants in Ukraine, the purpose of which is to achieve the European level of guaranteeing their legal status in the context of reforming the public administration of Ukraine in modern conditions of transformational changes. The expected result will be more efficient functioning of the public service thanks to the formation of a qualified state apparatus. The proposed mechanism includes two aspects of optimizing the mechanisms for protecting the rights of public servants: regulatory and organizational. In the context of improving the regulatory and legal mechanism, it is necessary to: democratize the process of protecting the rights of public servants by increasing its variability; to detail the protection procedure by applying to the Commissioner of the Verkhovna Rada of Ukraine for human rights and the European Court of Human Rights, provide the opportunity to travel abroad to civil servants and employees of local self-government bodies by amending the Law of Ukraine «On Martial Law» etc. In order to optimize the organizational mechanism, it is suggested: compliance with the organizational and legal principles of the implementation of state policy in the field of public service; ensuring legality during the procedure for taking positions by public servants; compliance with legal and legitimate requirements for passing and terminating civil service; increasing the role of trade unions in protecting the rights of public servants.
