Essay

In the dissertation work the scientific task, which consists in substantiation of theoretical foundations and development of practical recommendations on improving public administration of territorial community land resources has been solved. The concept of the territorial community land administration system, which contains a modernized organizational and functional structure of the administration subsystem (introduction of the district prefecture with control, supervisory and coordinating powers and involvement of community residents in the decision-making process on land asministration) has been proposed. It will enable to balance the division of functions regarding administration of land resources at the local level, reduce corruption risks, improve the quality of providing relevant administrative services, ensure publicity of administration in this area of public relations. Within the framework of the proposed concept, a model of interaction between subjects of public administration of territorial communiy land resources has been developed. In the course of the research the approach to systematization of the composition of territorial community land resources on the basis of determining the legal status and form of land ownership has been improved: narrow approach is actual and broad one - territorial. According to the narrow approach, only a set of communally owned land plots with a certain legal status is attributed to the lands of territorial communities, in accordance with which local governments make decisions within the powers granted to them. In the course of the study the classification of the subjects of public administration of land resourses has been improved by grouping them on the basis of decision-making into internal (local government bodies; community as a set of residents) and external (executive power authorities, institutions, organizations that directly make managerial decisions regarding land or objects that are located on it, and are also managers of information about land resources). External subjects of public administration are ordered into two classes according to the criterion of power availability: 1) those that are only information managers, 2) those whose list of powers includes land resources administration (territorial structural unit of the State Geocadastre of Ukraine, urban planning and architecture sector of the district state administration, departments of ecology and natural resources, agro-industrial development, culture and tourism, nationalities and religions of the regional state administration, State Property Fund of Ukraine), or objects located on them (basin water resources administrations, forestry enterprises, regional gas and electricity supply companies). The conceptual and categorical apparatus of public administration and management has been further developed by formulating the author's definitions of the concepts of "boundaries of the territorial community", "community land resources", "administrative-territorial basic level unit ", "community land resources administration":"territorial community boundaries " is a conditional closed line on the land surface, which was determined on the ground and entered into the state Geocadastre, which separates the administrative-territorial basic level unit from others and runs along the outer border of settlements that are part of the community; "сommunity land resources" is a territorially limited set of land plots of various forms of ownership (communal, state, private), for various purposes, the disposal of which is within the powers of village, settlement, town councils in the field of land relations on the territory of villages, settlements and their executive bodies ; "administrative-territorial basic level unit " is a part of the territory of Ukraine, which is the basis for the functioning of the territorial community and which is subject to the jurisdiction of its local governments; has its boundaries and is the territorial basis for the organization of power in Ukraine. As part of the study of approaches to the composition of territorial community land resources the author's unified definition of the concept of " territorial community land administration" has been formulated as a set of public administration active subject’s actions, aimed at an object that should have an organized nature and be aimed at achieving a specific goal : rational land use, high-quality land administration and land inventory, investment attraction and monitoring land tax payment, conducting a competent environmental policy within the community.
